The SMS consent requirements depend on whether a telephone number is required to submit the form.

Required Phone Number

If a patient must provide a telephone number in order to submit the form, the SMS opt-in checkbox and consent language should be presented clearly with the form.

Optional Phone Number

If the patient can submit the form without providing a telephone number, the specific SMS opt-in language may not be required for that form when SMS messaging is not being requested.

Best practice: Keep SMS consent separate from simply providing a telephone number. Patients should be able to choose whether they want SMS communications.
